Philippines: Amendments to the rules on employment permits

New rules on the issuing of Alien Employment Permits (AEPs) recently came into effect in the Philippines. These change the publication requirements of AEP applications. AEP application details must now be published in a general circulation newspaper and on the Department of Labour and Employment’s website for 30 days, and the details that will be published now include the foreign national’s name, their position, the employer and the employer’s address, a brief description of the functions to be performed, qualifications, salary and other benefits. In addition, the rules require employers to train two Filipino employees for every foreign worker employed in a non-managerial position in order that skills will be transferred to the local labour force. The list of categories of foreign nationals that are exempt or excluded from the requirement to obtain an AEP has also been extended under the new rules.
