Website

The term ‘website’ in the following terms and conditions shall relate to https://www.fedee.com and https://www.fedeeacademy.com, all their constituent pages, sub-directories and images and other FedEE® domains.

Intellectual Property

Our websites and their contents are the sole joint and exclusive property of FedEE® Corporate Services Limited, hereafter called the licensors or FCSL. Access to both the public areas of the website and password-protected areas of the website are subject to an access licence, the terms and conditions of which are set out below.

The Principal Licensee

La Federación de Empleadores Internacionales/La Fédération des Employeurs Internationaux/The Federation of International Employers is the principal licensee of our websites (hereinafter called the licencee or FedEE®).

Any reference to both parties, acting jointly or severally, will be made by the use of ‘we’ in the following text.

General – Public Website and Email Communication

Please read these terms and conditions carefully:

By making use of our websites, you agree to be bound by the terms and conditions set out below and by any additional terms and conditions set forth on individual pages of the websites. If you do not wish to be bound by these terms and conditions, do not continue to use or access our website(s). This agreement is governed by English law and jurisdiction.

All material on our websites is provided “as is” and made available to users for information purposes only.

Any opinions contained in this material are those of the individual authors concerned and do not necessarily reflect those of the organisations with whom they are associated.

The licensors reserve the right to make changes to the documents and/or other materials contained on these websites at any time without notice. This right also applies to these terms and conditions.

Online Language Translation

We offer users of fedee.com the use of online language translation services in order to read our material. However, we take no responsibility whatsoever for the consequent translations, or failure to translate any words or phrases in an accurate way. In all cases, the English language source material shall be considered the definitive text.

Products and Services

The descriptions contained in our websites of various products and services are provided solely for general informational purposes, and are not intended to be complete descriptions of all terms, conditions and exclusions applicable to the products and services.

Whilst the licensor takes all reasonable steps to ensure that the information contained within this website is accurate and up-to-date, no liability can be accepted for any out-of-date material, errors or omissions.

Both the licensor and FedEE Corporate Services Limited assume no liability whatsoever (whether direct or indirect) in connection with your use of the information provided on our websites or associated websites. We shall not be liable for any loss of profits, human resources, contracts or any direct, indirect or consequential loss, business interruption, or loss of data or programs arising out of or in connection with the use of the information either contained within our websites or from any other website to which we offer a hyperlink connection.

We accept no liability for any computer virus, bug, tampering, unauthorised access, intervention, alteration or use, fraud, theft, technical failure, error, omission, interruption, deletion, defect, delay, or any other event or occurrence beyond the reasonable control of either the licensor which corrupts or affects the administration, security, fairness and integrity or proper conduct of any aspect of our websites. Neither are we responsible or liable, directly or indirectly, for any loss or damage caused by use of or reliance on or inability to use or access our websites.

Although we have certain safeguards in place, any information directly or indirectly transmitted to or from the server hosting our websites cannot be guaranteed to be secure during transmission.

In providing the information contained in our websites, neither the licensors, licensee, nor any third party authors of the information provided are rendering any legal, accounting or other professional advice or opinions on specific facts or matters. Before taking any course of action or making any decision that may affect you or any associated party, you are strongly recommended to seek appropriate professional advice.

Password-Protected Areas

The principal areas of our websites are accessible only through the use of user identification and/or passwords. If you are, or have been, assigned or given selected user identification and passwords for access to these restricted areas, you are responsible for maintaining the security and confidentiality of that information and all information obtained through access to these restricted areas. You are responsible for all activities undertaken under an authorised identification and password. You may not allow any person outside your organisation to use your identification or passwords. This clause should be read in conjunction with FedEE Membership terms and conditions.

Hyperlinks

Our websites contain links to other websites independently maintained by other organisations and individuals. Because neither the licensors, nor FedEE or their officers control these third party websites we cannot make any representations regarding them and are not responsible for their content or the accuracy of the materials they contain. In addition, the link to these websites should not be construed as a recommendation, endorsement, adoption or approval by either the licensors or licensee of any products or services offered by the operators of these websites, or the views or opinions expressed therein. We are not responsible for your use of such linked websites, views expressed on them or the products or services offered by the operators of them.

Links to our websites are welcomed. However, full acknowledgement must be given to the source of information and no pages from our websites should be enclosed within the frame of any third party website, nor any similar arrangement that limits our data to part of a user’s full screen. Inclusion of a link to our websites should not be construed as a recommendation, endorsement, adoption or approval by the licensors or licensee of any products or services offered by the operators of these third party websites, or the views or opinions expressed therein.

Reproduction of part or all of the contents in any form is prohibited other than strictly for individual noncommercial use unless prior explicit permission has been given by the licensors. The material may not be recopied and/or shared with any third party. The permission to reproduce the material does not allow for incorporation of any part of it in any work or publication, whether in hard copy, electronic, or any other form unless publication rights have been explicitly granted in writing by the licensors. Use of the FedEE® logo is strictly forbidden except by paid-up members of FedEE® – and then only by way of indicating their affiliation.

Data protection and privacy – Website Visitors

General Terms

No cookies are contained on our websites and statistics concerning visitors to the websites are monitored on an aggregated basis. However, the licensors retain the right to investigate copyright infringements, cyber attacks and any instances where a password-protected area of the website is being entered without authorization.

As we do not monitor individual visitors to our website (unless suspected malware is detected) or use cookies it is not necessary to require visitors to acknowledge a privacy statement on entering the site.

Neither the licensors, nor licensee is in a position to use any personal information (information relating to your use of our websites which specifically identifies you or someone connected to you as a natural person) unless it is purposely sent to us, or the result of a lawful investigation for a serious tort or criminal act. We may, however, send you materials you have requested, place you onto a mailing list at your request and contact you regarding that request, and process data in connection with FedEE Membership or course participation. We will not disclose your personal information to any third party.

Where hyperlinks are provided to other websites it should be noted that they are not and cannot be governed by our Privacy Statement. We cannot guarantee your privacy when you access other websites through any hyperlink provided on this website.

FedEE Privacy Statement – FedEE Members

Your personal privacy matters a great deal to us. All personal data obtained and processed by The Federation of International Employers (FedEE), FedEE Corporate Services Limited and their affiliates is kept to a minimum, collected for specific and justifiable purposes, stored securely, not revealed to any party outside of the FedEE administration and not held longer than strictly necessary.

The way we handle personal data fully complies with FedEE’s own data privacy and protection code of practice, drawn up jointly through a member working group ahead of the GDPR. This is available free to members in the FedEE knowledgebase or on request via admin@fedee.com.

In common with all data transmitted via the Internet, personal data will be present in the ether of the WWW for such time as is necessary to be received, stored and utilized. Moreover, FedEE utilizes cloud technology – via WordPress and directly – for data storage, although protected by encryption and the use of VPN for access, using virus-protected systems. We also use up to date SSL Certificates for our Websites.

All FedEE personnel are subject to employment contractual clauses that strictly limit their access to, and processing of, all personal data and bind them to respect data privacy in perpetuity. Only the minimum of staff members are allowed access to databases containing personal data provided by members, fellows, course participants, users and third parties.

FedEE Membership data is held securely by the membership database company in Toronto, Canada (a country with formal EU adequacy status). In the unlikely event of a data breach all those affected will be notified immediately and the relevant data protection authority informed. If any user wishes to obtain a copy of what we hold on file about them, please contact the FedEE Membership Secretary. We recognise that all data subjects have the right to be forgotten and will completely remove all personal data about a specific and identifiable data subject upon request.

Communications

We are under no obligation to respond to any communications through the emails, fax, text, telephone, social network, messaging system or postal services directed through contact points published on our websites or in our literature, apart from any formal complaint, or a bone fide personal privacy enquiry/complaint.

Dispute Resolution

The provision of public website data/material does not in any way create a supplier-consumer relationship unless products or services are provided on a formal, written commercial basis. Any complaints raised by consumers against FedEE® ‘s online services (or any affiliate) shall be resolved in the first instance by amicable discussion and negotiation between the parties. This shall be initiated by the raising of a complaint by email to admin@fedee.com. If no agreement is reached the parties within a period of six weeks we shall mutually appoint an independent mediator who shall settle the dispute by issuing a reasoned recommendation. This procedure shall be fully compliant with the EU Online Dispute Resolution Regulation (Regulation (EU) 524/2013) and UK implementation of the EU Alternative Dispute Directive (2013/11/EU).

The European Commission operates an online disputes referral system for consumers in another EU State. Please therefore also submit complaints through its portal at here.

Miscellaneous Provisions

Any waiver of any provision of these terms and conditions must be in writing and signed by, or authorised by, the licensors to be valid. A waiver of any provision hereunder shall not operate as a waiver of any other provision, or a continuing waiver of the same provision in the future. If any court of competent jurisdiction finds any provision of these terms and conditions to be void or unenforceable for any reason, then such provision shall be ineffective to the extent of the court’s finding without affecting the validity and enforceability of any remaining provisions. For those who are not Members of FedEE or its clients or clients of its affiliates®, these terms and conditions represent the entire understanding and agreement between you and the licensors relating to use of our websites or matters arising from them, and supersede any and all prior statements, understandings or agreements whether oral or written.
